Acceptance of Terms

By downloading, installing, accessing, or using the Golf Bump mobile application or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Golf Bump, LLC ("Golf Bump," "we," "us," or "our"). The corporate headquarters for Golf Bump, LLC is in Sun Prairie, WI.

If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service following the posting of any changes to these Terms constitutes acceptance of those changes.

Eligibility

You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement. Golf Bump is not directed at children under the age of 18, and we do not knowingly collect personal information from anyone under 18 years of age.

Account Registration

To use the Service, you must create an account by providing accurate, current, and complete information as prompted during the registration process. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying Golf Bump immediately of any unauthorized use of your account
• Ensuring that your profile information remains accurate and up to date

You may not create more than one account per person. Golf Bump reserves the right to suspend or terminate accounts that are found to contain false or misleading information.

Subscription and Payment

Golf Bump offers subscription-based access to its platform and services. By subscribing, you agree to the following:

• Subscription Plans: Golf Bump offers various subscription plans as described within the application. Details regarding pricing, features, and billing frequency are presented at the time of purchase.
• Payment Processing: All payments are processed through Apple App Store or Google Play, depending on your device platform. Golf Bump, LLC does not directly collect or store payment information.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled by you prior to the renewal date. You may manage your subscription and turn off auto-renewal through your device's app store settings.
• Refunds: Refund requests are subject to the refund policies of Apple App Store or Google Play, as applicable. Golf Bump does not process refunds directly.
• Free Trials: If a free trial is offered, it will convert to a paid subscription at the end of the trial period unless canceled before the trial expires.

Description of Services

Golf Bump provides a community platform for golfers that includes the following features and services:

• Golf round scheduling and coordination
• Member network management
• Post-round feedback and rating systems
• Group management and categorization
• Location-based member discovery and proximity alerts
• Cloud synchronization across devices
• Community messaging and group coordination
• Achievements and leaderboards
• Course information and reviews

Golf Bump reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

User Conduct

You agree to use the Service in a lawful and respectful manner. You shall not:

• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, threaten, or intimidate other users
• Post or transmit content that is obscene, offensive, defamatory, or otherwise objectionable
• Impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Use any automated means to access the Service, including bots, scrapers, or crawlers
• Collect or store personal data about other users without their consent
• Use the Service to send unsolicited communications or spam

Golf Bump reserves the right to investigate and take appropriate action against anyone who violates these provisions, including removing content, suspending or terminating accounts, and reporting violations to law enforcement.

User-Generated Content

The Service may allow you to post, submit, or share content, including but not limited to profile information, golf round data, reviews, ratings, messages, and other materials ("User Content"). By submitting User Content, you:

• Represent and warrant that you own or have the necessary rights to submit such content
• Grant Golf Bump a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your User Content in connection with operating and providing the Service
• Acknowledge that your User Content may be visible to other users of the Service based on your privacy settings

Golf Bump does not claim ownership of your User Content. However, we reserve the right to remove any User Content that violates these Terms or that we find objectionable in our sole discretion.

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Golf Bump, LLC and are protected by copyright, trademark, and other intellectual property laws. Our trademarks, logos, and service marks may not be used in connection with any product or service without the prior written consent of Golf Bump, LLC.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes, subject to these Terms.

Location Services

Certain features of the Service utilize location-based data, including member discovery and proximity alerts. By enabling location services:

• You consent to the collection and processing of your location data as described in our Privacy Policy
• You understand that location data is used to provide features such as nearby member discovery and proximity alerts
• You may disable location services at any time through your device settings, though this may limit certain features of the Service

Golf Bump handles location data in accordance with its Privacy Policy and applicable data protection laws.

Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and protection of your personal information.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Golf Bump does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the Service will be accurate or reliable
• Any errors in the Service will be corrected

Golf Bump is not responsible for the conduct of any user on or off the Service. You use the Service at your own risk and are solely responsible for your interactions with other users.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOLF BUMP, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to, use of, or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to defend, indemnify, and hold harmless Golf Bump, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

Termination

Golf Bump may terminate or suspend your account and access to the Service at any time, with or without cause and with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• Golf Bump may delete your account information and User Content
• Any provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

You may terminate your account at any time by deleting your account through the application settings. Please note that canceling your subscription does not automatically delete your account.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Dane County, Wisconsin.

Platform-Specific Terms

In addition to these Golf Bump Terms of Service, your use of the Service is also subject to the terms and conditions of the platform from which you downloaded the application:

In the event of any conflict between these Terms and the applicable app store terms, the app store terms shall prevail with respect to matters relating to the app store's services, and these Terms shall prevail with respect to all other matters.

Changes to These Terms

Golf Bump, LLC reserves the right to modify these Terms at any time. If material changes are made, we will notify users through the application or by other appropriate means. Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms.
